Independent Contractor Notice
This Notice clarifies the working relationship between Empire Facility Solutions Group ("EFSG"), a DBA and brand of Empire Business Solutions & Advertising LLC, and the independent service providers who perform cleaning services coordinated through EFSG.
1. Independent Contractor Status
Service providers are engaged as independent contractors and receive IRS Form 1099 where applicable. They are not employees of EFSG or Empire Business Solutions & Advertising LLC.
2. No Employment Relationship
This relationship does not create employment, partnership, joint venture, or agency. Providers are not entitled to employee benefits, including health insurance, paid leave, or unemployment benefits.
3. Control Over Work
Providers set their own schedules, choose which jobs to accept or decline, and control the manner and means by which accepted work is performed, consistent with agreed quality standards.
4. Taxes
Providers are solely responsible for reporting and paying their own federal, state, and local taxes, including self-employment taxes. EFSG does not withhold taxes on their behalf.
5. Tools and Expenses
Unless otherwise agreed in writing, Providers furnish their own supplies and equipment and are responsible for their own business expenses.
6. Acknowledgment
By accepting jobs coordinated through EFSG, Providers acknowledge and agree to the independent contractor relationship described in this Notice and in our Provider Terms.
